Virtual CLE Program: The Role of Carbon Storage in the New Climate Policy

The Forum and BakerHostetler LLP invite you to join us for a Virtual CLE Program on Wednesday, June 23rd. This presentation will focus on long-term storage of carbon dioxide either to reduce volumes emitted from new facilities or to remove carbon dioxide already in the atmosphere for potential use as carbon offsets in emissions trading. The two broad approaches to carbon capture are capturing carbon dioxide in flue gases before they are admitted or to remove carbon dioxide already in the atmosphere. Removal itself follows two broad approaches: mechanical and biological. Mechanical capture is through “direct air capture,” a technique already commercial on a small scale. Biological capture is through natural photosynthesis. Carbon is stored in trees, grasses, and soil.
The presentation will discuss the state of play in removal, the regulation of mechanical removal of carbon dioxide in flue gas and through direct air capture, its long-term “sequestration” under the Clean Air Act, and the treatment of biological removal under cap-and-trade programs.
