The Forum and Alston & Bird invite you to join us for a Virtual CLE Program on Thursday, December 3rd discussing the unprecedented nature of COVID-19 and the response to it shined a spotlight on the relatively obscure contractual defense of force majeure (literally, “greater force”). When a party fails to live up to its contractual obligations because of events beyond its control, it may try to rely on a force majeure clause to excuse its breach. In Texas, disputes over the applicability of force majeure provisions are particularly common in the oil patch, but they can pop up in almost any industry. This talk will help you build strategies for drafting, negotiating, and litigating force majeure in the context of a pandemic.
