While on the other hand, Texas law makers have banned state entities from doing business with ESG-focused market players that allegedly discriminate against gun makers and oil and gas companies, and in particular, banks vying to underwrite municipal securities in Texas are required to publicly certify their commitment to not harming guns or fossil fuel production. Proactively and consistently threading the needle between ESG-focused SEC disclosure demand and countervailing Lone Star threats to “boycott the boycotters” is critical to risk mitigation for companies doing business in Texas.
