Free movement throughout the Community thus became a fundamental right for the workers of the member states. This leap of quality was greatly favoured by the economic conditions of the time: since economic growth had abated migratory pressure from Italy to the other member states, ‘the mobility of the European workers was no longer socially and politically dangerous’ (van der Mei 2003, 26).

There is little doubt that ‘the activism by the European Court of Justice has transformed EU citizenship from a derivative status to a free-standing source of rights’ (Joppke 2010b, 22). 32 Mobile Europe As Foster writes (2011, 373): ‘It is clear that the legal regime regulating the free movement of persons has come a long way from the near-empty and little-used original Treaty provision for it. ’ This sort of preoccupation resonated particularly in connection with the euro crisis of the late 2000s–early 2010s and the increasing success of neo-nationalist parties.

The definitive implementation of the free movement principle came in 1968, when Regulation 1612/68 and Directive 68/360 abolished all restrictions on the movement and residence of Community workers and their families. Regulation 1612/68 prohibited any discrimination based on nationality for migrants from other member states as regards remuneration, conditions of employment and unemployment benefit. It also established the right of Community workers to equal treatment by guaranteeing to their families the right to reside with them and take up any type of employment in the host country.
