One could argue that no two professions conjure more emotion than accounting and law. Although some may liken the two to taxes, insurance, or a trip to the dentist (necessary, but painfully expensive) both accountants and attorneys are vital to business success, especially during such turbulent times.
Recent developments illustrate the differences between the two professions are vast. Many predict the findings contained in the March 11, 2010, report from the examiner on Lehman Brothers Holdings bankruptcy may drive a larger wedge and is certain to bring about additional change. Bold statements, such as "auditors put clients before investors", "technical compliance with laws and rules does not insulate auditors and directors from liability" and "officers breached their fiduciary duty to their company, their board and their investors board by not disclosing certain facts" have challenged both professions to re-consider previous positions on the topic. Our distinguished panel includes two general counsel with significant experience in this arena, along with an outside attorney and an accountant, both of whom formerly held senior positions at the Securities and Exchange Commission.
